Dealership sues over construction
FAIRFIELD
Auto dealership owner Geza Scap has filed a lawsuit in Bridgeport Superior Court that claims construction of the new Super Stop & Shop on Villa Avenue damaged a retaining wall and automobiles at his business next door.
Scap’s lawsuit names as defendants the town, a limited liability company that owns Villa Avenue land where the new Super Stop & Shop is located and Suffolk Construction Co. in Hartford.
Scap’s lawsuit says blasting done for the new supermarket removed a lateral support from the retaining wall that separates his dealership from the supermarket, changed the grades of land around his dealership and flow of water onto his property and shifted boulders that support his property “in such a manner as to seriously threaten the integrity of the structures” on his land.
Scap also blamed construction of the 75,000-square-foot supermarket for damaging his inventory of automobiles because it generated “excessive dirt, grime and other substances in the area.”
